Renewal of Cultural Monuments

How to proceed

In the case of an intention to carry out a renewal of a movable cultural monument, immovable cultural monument or property located in a historically protected area, an obligation arises to request in advance a binding opinion of the Heritage Department of Prague City Hall (PCH HD).

The object of an assessment is any intervention or intention, which, on the basis of relevant provisions of special legal regulations, requires a binding opinion of the given body (planning permission, building permit, notification, change of the purpose of use of the building, occupancy permit, additional building permit, etc.), or where the obligation to request a binding opinion is set down by Act No. 20/1987 Coll., On State Monument Care, as amended (restoration of movable cultural monuments, placement of installations, placement of pavement restaurants, woody species treatment, etc.)

In the case of a cultural monument (both movable and immovable), the binding opinion can only be requested by the owner. In the case of real estates, which are not cultural monuments but are located in a monument reservation, monument zone or a protective zone, the binding opinion can be requested by the owner, the administrator or the user.

Upon written request and after prior statement of a professional organization of State monument care (National Heritage Institute) PCH HD issues a binding opinion.

A binding opinion of PCH HD is a binding basis for the decision of the relevant administrative body on the matter, or an independent administrative decision in the event that subsequently no other administrative body has the authority to decide on the matter.


Forms, requirements, documents

The request does not have to be filled on the prepared form, but it must contain:

  • Identification of the property or movable cultural monument
  • Identification of the applicant
  • Valid proof of ownership of the property (copy of an entry from the Land Registry) or movable cultural monument

Certified power of attorney indicating the scope of authorisation for the representative of the applicant  in case of representation (template at   http://pamatky.praha.eu/ )

  • Proof of legal personality of the applicant, or authorised representative (copy of an entry in the Commercial Register, Trade Register)
  • Project documents (project documentation, if elaborated and required by relevant provisions of Act No.183/2006 Coll., On Town And Country Planning and Building Code, as amended, or by PCH-HD)
  • Building and historical research (does not apply to properties in protective zones)
  • Proposal of restoration intervention and photographic documentation of present state for movable cultural monuments

Processing times

30 days, in particularly complex cases 60 days (S.71 (3) (a) Act No. 500/2004 Coll., Rules of Administrative Procedure, as amended)

The request with all the above mentioned elements shall be addressed to PCH-HD. It can be filed by post, by public data network into PCH’s data box or in person at the main PCH filing office, in the lobby of PCH.
